These Terms & Conditions (“Terms”) govern your use of the madeinpanda.shop website (the “Website”) and your purchase of products from MadeInPanda (“we”, “us”, or “our”). By accessing the Website or placing an order, you agree to be bound by these Terms.

General

We reserve the right to update or modify these Terms at any time. Changes become effective when posted on this page. Your continued use of the Website after changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

Eligibility

By using our Website, you confirm that you are at least 18 years old, or that you are accessing the Website under the supervision of a parent or guardian. You are responsible for the accuracy of the information you provide when placing an order.

Products and Pricing

  • All prices are listed in US Dollars (USD).
  • We make every effort to display product images, descriptions, and prices accurately. However, we do not warrant that product descriptions, colours, or other content are error-free.
  • We reserve the right to change product prices at any time without prior notice. Prices are confirmed at the time you place your order.
  • While we aim to keep all products in stock, availability is not guaranteed. If a product becomes unavailable after you place an order, we will notify you and either offer a substitute or issue a full refund.

Orders and Acceptance

  • An order is not accepted until we send you an order confirmation email.
  • We reserve the right to refuse or cancel any order for reasons including, but not limited to, suspected fraud, incorrect pricing, stock unavailability, or errors in order details.
  • If we cancel an order after payment, we will issue a full refund to your original payment method.

Shipping and Delivery

  • Freight is always paid by the customer and calculated by total order weight at checkout. Orders under $1,000 ship duties-included (DDP); how VAT/GST is treated for your destination is stated on your order confirmation with freight charged separately; orders of $1,000 or more ship FOB Ningbo, Shanghai or Shenzhen.
  • Shipping times and delivery estimates are provided at checkout and are estimates only. For DDP orders, we handle customs clearance and carrier issues until delivery. For FOB orders, we are not responsible for delays caused by customs, carrier issues, or events beyond our reasonable control after handover.
  • Risk of loss and title for products pass to you upon delivery to you. For orders under $1,000 shipped DDP (duties included), we bear the risk until the order is delivered to you. For orders of $1,000 or more shipped FOB, risk passes to you when the order is handed to the carrier or your designated forwarder. You are responsible for providing an accurate shipping address; we are not responsible for items delivered to an incorrect address provided by you.

Returns and Refunds

Our return and refund policy is set out on our Refund Policy page and forms part of these Terms. By placing an order, you agree to the terms of our Refund Policy.

Payment

  • We accept payment via PayPal, Visa, Mastercard and American Express (cards paid through PayPal), and Google Pay. Apple Pay is available on supported Apple devices.
  • Payment is processed securely. We do not store your full card details.
  • All payments are subject to verification and authorisation by the payment provider.

Intellectual Property

All content on the Website, including text, graphics, logos, images, and software, is the property of MadeInPanda or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use any content without our prior written consent.

Limitation of Liability

To the maximum extent permitted by law, MadeInPanda shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Website or purchase of products. Our total liability shall not exceed the amount you paid for the products in question.

Disclaimer of Warranties

The Website and products are provided “as is” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law.

Indemnification

You agree to indemnify and hold harmless MadeInPanda and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including legal fees) arising out of your use of the Website, your violation of these Terms, or your violation of any rights of a third party.

Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the competent courts.
